Background

            With a view to establish interaction and relation among Santals, "Delhi Santal Employees' Welfare Association" was formed in the year 1990. A need was felt to broad base its areas of activities and coverage, and the same organisation was dissolved and All India Adivasi Socio-Educational and Cultural Association "All India ASECA" was founded in a meeting held on 18th August, 1995 at G-624, Sarojini Nagar, New Delhi. The name "ASECA" was adopted in recognition of the pioneering work done by these Associations in the States of Orissa, Bihar and West Bengal for the welfare and development of Adivasis. Memorandum and Rules and Regulations of the Association were framed according more responsibility to its members to perform. The Association was registered with the Registrar of Societies, Govt. of NCT Delhi on 13th December, 1996 under the Societies Registration Act, 1860 (registration number S-30626-96). From the inception it was envisaged that this Association will work with required/desired thrust for the welfare of the Adivasis on all India level. Membership is spread in more than eight states and that is one of the remarkable features of this association and members are professionals in different fields.

 


Memorandum of Association

1. NAME OF THE ASSOCIATION

The Association shall be called as " ALL INDIA ADIVASI SOCIO EDUCATIONAL AND CULTURAL ASSOCIATION" (ALL INDIA ASECA).

2. REGISTERED OFFICE

The Office of the Association shall remain in the National Capital Territory Delhi and at present it is at the following address:

    D-209, Sarojini Nagar, New Delhi – 110 023.

              (Office has been shifted to SFS Flat No. 326, Pocket 10, Sector 11 (Extension), Rohini, Delhi 110 085)

            Local Centers may be established at such other places as the Governing Body may from time to time determine.

 3. AIMS AND OBJECTS
  1. To encourage and preserve the traditional heritage including socio-cultural institutions of Adivasi and to educate people regarding social evils and the harmful practices of society;
  2. To pool together talents and resources available with the members and non-members and to organise exchange of expertise and experiences of members and non-members to encourage research on Adivasi heritage, socio-cultural institutions and languages;
  3. To establish such institutions for the promotion of Education and Literature in Santali and/or its other sister languages with the medium of Adivasi "OL CHIKI" script;
  4. To disseminate the awareness of the richness of Adivasi culture particularly among the urban educated people so as to inculcate in them respect and admiration for the contributions of the Adivasi communities to various facets of Indian Culture;
  5. To organise, promote and afford facilities to indoor and outdoor games, any form of sports, recreation, sport competitions, events, cultural activities, social activities, exhibitions and publications.

        All the incomes, earnings, movable, immovable properties of the Association shall be solely utilised and applied towards the promotion of its aims and objects only as set forth in the Memorandum of Association and no profit on thereof shall be paid or transferred directly or indirectly by way of dividends, bonus, profits or in any manner whatsoever to the present or past Members of the Association or to any person claiming through any one or more of the present or past members. No member of the Association shall have any personal claims on any movable or immovable properties of the Association or make any profits whatsoever, by virtue of his membership.

4. GOVERNING BODY

The names, addresses, occupations and designations of the present members of the Governing Body to whom the management of the Association is entrusted as required under Section 2 of the Societies Registration Act, 1860 as applicable to the National Capital Territory, Delhi are as follows:

RULES AND REGULATIONS

 

1. NAME OF THE ASSOCIATION

    The Association shall be called as "ALL INDIA ADIVASI SOCIO EDUCATIONAL AND CULTURAL ASSOCIATION" (ALL INDIA ASECA)

2. MEMBERSHIP

Any adult male or female who believes in the Aims and objects of the Association has to apply in the prescribed form for membership subject to his introduction by an old member. He shall be considered as a member of the Association provided the prescribed subscription is paid.

3. ADMISSION AND QUALIFICATION FOR MEMBERSHIP

Members of the Association shall be admitted subject to the approval of the Governing Body. The Governing Body is impowered to accept the application of any person for membership. However, the Governing Body shall have the power to refuse/reject the application for membership of a person. The same shall be communicated to the concerned applicant who may file an appeal before the General Body within 60 days after having received such information. The decision of the General Body shall be final. The applicant deemed to be a member shall join the Association from the date specified by the Governing Body.

4. SUBSCRIPTION

The subscription for membership shall be Rs 100/-(Rupees One Hundred only) per annum and Rs 2001/- (Rupees Two Thousand and one only) for life in addition to Rs 10/- (Ten) towards entry fee. The same amount shall be realised from the desirous member at such interval as decided by the Governing Body. However, for students who volunteer themselves to be the member of this Association may be exempted /relaxed from paying such amount as may be decided by the Governing Body. Subscription once paid shall not be refunded. A member shall pay the share of expenditure of the Association as approved by the Governing Body.

5. CESSATION OF MEMBERSHIP

The membership shall cease automatically on the following grounds:-

  1. If the member fails to pay the prescribed subscription for consecutive 2 years;
  2. If he/she tenders resignation and duly approved by the Governing Body;
  3. If he/she fails to attend 3(three) consecutive meetings of the Governing Body/General Body, as the case may be, without cogent reasons. Reason for his/her removal from membership shall be intimated to him/her

6. APPEAL AND RE-ADMISSION OF MEMBERS

The Governing Body is impowered to expel any member in his conduct is found as working against the aims and objects of the Association and its smooth working. Member so expelled may go for appeal before the General Body for re-admission within the period of 60 days after the receipt of such information. The decision passed by the General Body shall be final.

7. RIGHTS AND PRIVILEGES OF MEMBERSHIP

7.1    Every enlisted members would be eligible to vote and contest for the post in the Governing Body provided the membership is valid.

7.2    The founder members of this Association shall have the privilege to be intimated for participation in all General Body Meetings as members and their views shall be given due weightage provided they have not been expelled from the Association on grounds of activities given in Clause 9.1(c) or resigned from the Association.

8. GENERAL BODY

8.1 Definition

There shall be a General Body of the Association consisting of all the members. The decision on any matter shall be taken by consensus in the first instance by raising of hands. A poll shall be taken if any five members present demand it or the President considers it necessary. The result of the poll shall supersede the result of a vote taken by raising of hands. In case of a tie, the President shall have a casting vote.

8.2 Powers and Duties, Function of General Body

  1. To prepare complete details of annual programmes and policies;
  2. To pass annual budget of the Association;
  3. To discuss and decide all such other matters and issues which are directly or indirectly related to the affairs of the Association;
  4. To appoint an auditor who will annually inspect the accounts of the Association's funds;
  5. To undertake any other matter of policy and importance for upliftment of the community;
  6. To dispose of all affairs of common welfare and interest of the community brought in the Agenda or permitted by the President for consideration at the spot;
  7. To make any amendment in the Memorandum of Association and Rules and Regulations of the Association

8.3 Notice of Meeting and Periodicity of Meeting

The notice for the General Body meeting should be despatched at least 45 (forty five) days before the meeting from the date of issue. Letters in respect of the meeting to be held will be sent to every member of the General Body by General Secretary with the Agenda stating the date, time and place of the proposed meeting after obtaining the permission of the Governing Body. The meeting of the General Body shall be held once a year with 1/3 quorum. No quorum shall be required in the adjourned meeting. An emergent meeting of the General Body may also be summoned on the written request of 3/5 members. In case of no quorum, the President may adjourn the meeting and determine a day not being less than 7 days thereafter. The members then present shall constitute the quorum and transact the business for which the meeting was convened.

9. GOVERNING BODY

9.1 Definition

There shall be a Governing Body of the Association to look after and manage the day-to-day affairs of the Association. Inter-alia these are:

  1. To take necessary steps for the implementation of all the programmes and policies drawn by the General Body;
  2. To pass the necessary expenditure to meet the day-to-day requirements of the Association;
  3. To suspend/remove immediately any member from the Association when it is observed that such member is causing hindrance/obstruction in the smooth working of the Association, undermines the interest of the Association;
  4. To invite any person(s) or cognoscenti other than members of the Association to join in the meetings of General Body and /or Governing Body at particular occasion. The advice/suggestion/proposals mady by the guest(s) will be considered liberally in the interest of the Association and the community in general;
  5. To take all such other steps which may appear beneficial for the smooth and better management of the Association.

The decision on any matter shall be taken by consensus in the first instance by raising of hands. Also, the President, if he considers expedient may obtain the views of the Governing Body on any matter by circulation of the matter to the office bearers of the Governing Body. In case all agree, the matter shall be taken as cleared by the Governing Body. Otherwise, it shall be brought on the Agenda of the next meeting.

9.2 Composition

The composition of the Governing Body at present shall be as under which may be modified consistent with the provision under clause 9.3

9.3 Minimum and Maximum strength including Office Bearers

The Governing Body shall consist of minimum 11 (Eleven) and maximum 25 (Twenty five) members including the office bearers.

9.4 Election and its Mode

9.4.1     The office bearers and members of the Governing Body shall be elected directly either by Ballot papers, raising of hands or by consensus in the General Body Meeting. Voting through ballot papers shall take place when 3/5 members demand for it in writing 30 days before the date of the General Body Meeting. Thereupon, an Election Committee comprised of one Presiding Officer assisted by not less than two Polling Officer shall be formed or appointed by the existing Governing Body to announce and conduct election process properly within a month. The election should be held before the expiry of the term of the existing Governing Body.

9.4.2     For members staying outside Delhi may cast vote by post or by sending to the Polling Officer their Ballot papers by suitable communication medium in case voting through Ballot papers takes place. He/she shall be provided with the Ballot paper by the Election Committee at least two weeks in advance from the date of election. The Polling Officer will open such letter only at the time of counting of votes. The result of the polling will be announced by the Election Committee on the same day.

9.5 Terms of the Office of the Governing Body

The term for the Governing Body shall be of two years from the date of assumption its office normally from first May of the commencing term.

9.6 Powers and Duties of the Office Bearers

    9.6.1.  President

  1. He will be the Chief Executive of the Association having full control over the work of all the members of the Governing Body:
  2. He will preside over all the meeting of the Governing Body / General Body except at any meeting while any resolution for his removal is under consideration;
  3. He shall abide by the decisions passed by the Governing Body and General Body;
  4. He will take all necessary steps to implement the decisions of the Governing Body and General Body;
  5. On vital issues, he will decide the matter in consultation with other office bearers of the Governing Body.

    9.6.2 Vice-President

He shall assist the President in all possible manner and shall act as President in all possible ways in case of latter’s absence or while any resolution for the removal of the President is under consideration.

     9.6.3 General Secretary
  1. He will be the principal in-charge of all management affairs of the Association.
  2. He will work in close co-operation with the President and other office bearers;
  3. He is entitled to requisition any member of the Association to assist him in the performance of his duties and shall keep the President informed of all matters of importance to draw his immediate attention for consideration;
  4. He shall maintain all records of correspondences/ meetings / conferences / programmes and minutes book safely in his personal custody;
  5. He will make correspondence with Govt. or other national or State Govt. organisations in the matter warranting the interests of the Association;
  6. Such other miscellaneous works as entrusted upon by the Governing Body or the President from time to time.
     9.6.4 Secretary

He shall assist General Secretary in all possible manner and shall act as General Secretary in case of latter’s absence.

     9.6.5  Treasurer
  1. He will be the Chief Custodian of all kinds of funds;
  2. He will maintain accurate accounts of cash received and payments made;
  3. He will be responsible to keep all the cash in any of the Public Sector Banks. He may keep cash in hand as authorised by the Governing Body;
  4. He will maintain proper record of all the receipt books (both used and unused) to avoid misused. The receipt books for collection of donations and subscriptions etc., will be issued against proper receipts as permitted by the Governing Body;
  5. All kinds of financial transactions will be routed through him against proper entries in the relevant registers;
  6. The comments and objections observed by the Auditor will be rectified and his instructions will be adhered to strictly for future working;
  7. He will put up the Auditor’s report before the President through the General Secretary for information in order to get it approved by the General Body.
     9.6.6 Quorum and Notice of the Meeting

The meeting of the Governing Body shall be held at least once in a month with 3/5 quorum. No quorum shall be required for the adjourned meeting. An emergent meeting of the Governing Body may also be summoned at short notice as the President and/or General Secretary may deem necessary. Notice to hold meeting shall be communicated to the Members of the Governing Body by any available/ suitable communication medium. Non-receipt of notice by any members shall not invalidate the decisions taken in the said meeting.

    9.6.7 Filling up Casual Vacancies

Casual vacancies, if any, shall be filled up or the work of some of the office bearers shall be looked after as per the provisions of the ‘Rules and Regulations’ of the Association or as the Governing Body may decide for the smooth functioning of the Association.

10. SUB-COMMITTEE, IF ANY, ITS FORMATION- II (COMPOSITION-III), DUTIES AND FUNCITONS

The Governing Body may from time to time constitute Sub-committee to undertake any specific work. The composition, duties, functions of such Sub-committee shall be decided by the Governing Body and the Sub-Committee shall prepare its report for the consideration of the Governing Body within the specified time frame.

11. SOURCES AND UTILISATION OF FUNDS

11.1 Sources of Funds

a) Membership fee and subscription received from individual members.

b) Donation, contributions and gifts made to the Association by individual(s) and other bodies / associations / unit.

c) Grant-in aid through any sources of Government and/or registered bodies.

11.2 Utilisation of Funds

All the sources of income, properties (movable and immovable) assets earned by the Association shall be used entirely for the benefits, welfare of the Association, Under no circumstances, any part of the assets shall be transferred in the name of any particular member or members or utilised for personal benefits. No member or the office bearer shall be entitled to any salary, remuneration and honorarium etc., for his devotion except the expenses actually incurred by him/her from his/her pocket for the activities of the Association.

12. AUDIT OF ACCOUNTS

All the account will be checked / audited by the Auditor(s) duly recognised by the Government preferably in the first fortnight of April every year.

13. OPERATION OF BANK ACCOUNT

The funds of the Association shall be kept in a Public Sector Bank. The account shall be operated by the General Secretary and Treasurer with the joint signatures.

14. ANNUAL LIST OF GOVERNING BODY

Once in a year a list of the office bearers and members of the Governing Body of the Association shall be filled with the Registrar of Societies, Delhi as required under Section 4 of the Societies Registration Act, 1860.

15. YEAR ENDING

The year of the Association shall close on the 31st of March every year according to English Calendar and shall begin from the 1st day of April every year.

16. LEGAL PROCEEDING

The Association may sue or be sued in the name of the President, General Secretary as per provisions laid down under Section 6 of the Societies Registration Act, 1860 as applicable to the National Capital Territory, Delhi.

17. AMENDMENT IN THE MEMORANDUM OF ASSOCIATION OR RULES AND REGULATION

Any amendment in the Memorandum of Association or Rules and Regulation will be carried out in accordance with procedure laid down under Section 12 and 12-A of the Societies Registration Act, 1860.

18. DISSOLUTION AND ADJUSTMENT OF AFFAIRS

If the Association needs to be dissolved, it shall be dissolved as per the provisions laid down under Section 13 and 14 of the Societies Registration Act, 1860 as applicable to the National Capital Territory, Delhi.

19. APPLICATION OF THE ACT

All the provisions under all the Sections of the Societies Registration Act, 1860, as applicable to the National Capital Territory Delhi, shall apply to this Association.
